Appeal of denial
In order to appeal a denial, one must promptly send a letter to the agency. Most agencies require
that appeals be made within 30 to 60 days after the denial. Under the FOIA, the agency has 20 working
days (excluding Saturdays, Sundays, and federal holidays) to decide your appeal. Under certain
circumstances, agencies may extend the deadline for responding to your appeal by up to 10 working
days. At some agencies, as with initial requests, some appeals may take longer to decide.
