Employer has to prove that -
 Employee has suffered violence in form of assault, battery, or stalking or there is a credible
threat of violence.
 This violence or threat of violence is likely to be carried out or has been carried out at the
workplace.
 Conduct is not allowed as legitimate labor dispute.
 Accused person should not be engaged in constitutionally protected activity.
