I am applying for a religious worker visa, yet don't have an approved petition. I have been to the United States beforehand with a R-1 visa and was not required to have the petition. Can I apply for an R-1 visa without the petition since I had an R-1 visa in the past?

R-1 non immigrant visa

The prerequisite for an affirmed request of became effective November 28, 2008. All
candidates applying for a R-1 non immigrant visa are required to have an approved petition to
from U.S. Citizenship and Immigration Services (USCIS).
